Senate Passes Castle Doctrine

The Pennsylvania Senate has approved the bill that could see the Castle Doctrine in Pennsylvania defending home owners who act in self defense if their homes are suddenly invaded by burglars intent on harming those inside.

The Castle Doctrine would ultimately eliminate the duty to retreat clause if a person finds themselves threatened by an assailant in any location that person has a basic right to be, which also includes the home owner’s home or vehicle.

Furthermore, if self defense action is taken to protect the individual’s family, home and themselves, the legislation would present vital protections against possible civil litigation or criminal prosecution to those who take the necessary action to defend themselves.

This bill comes to the great delight of many home owners who have found themselves targeted by invaders in their homes or vehicles, only to realize that their rights of protecting themselves from possible harm inflicted by their assailant is often regarded higher than their own.

In this day and age, a criminal’s rights should not be placed on a higher pedal stool then those of law-abiding citizens. If a home owner is required to make the first move at defending their property and their families they should not have to worry about the possible litigation charges involved simply because they decided to take action first.

For centuries, home owners have taken measures in order to protect what is rightfully theirs. If someone attempted to steal from the homes of others, then they were faced with the ramifications of their actions when the home owners caught them.

How it is possible in this era for a career criminal’s basic rights to be regarded higher compared to those of law-abiding citizens is for many a shocking revelation. However, with the implementation of the Castle Doctrine bill there will be countless home owners who will no longer have to worry about what it could mean for them if they are required to protect what is theirs.

This, after all, is how it should be. Just like it has been done since time began, if a home is invaded by unwanted individuals, then a home owner should be able to defend their castle, regardless of the fact that they make the first move or not.
